VideoGPT Privacy Policy
Effective date: September 23, 2026
VideoGPT is operated by ElevenThirteen LLC (“VideoGPT,” “we,” “us,” or “our”). This Privacy Policy describes how we collect, use, disclose, and retain information when you use our websites, apps, AI generation tools, public feed, and related services (the “Services”).
1. Information we collect
Account and profile information. We collect information you provide, such as your name or display name, email address, username, profile photo, and account settings. When you sign in with Apple, Google, or Discord, we receive account identifiers and other information the sign-in provider shares with us under your settings and its policies. We do not receive your password for those services.
Prompts, uploads, and outputs. We collect the prompts, instructions, generation settings, reference materials, images, videos, audio, and other files you submit, as well as the generated outputs, associated metadata, and feedback. These materials can contain personal information about you or others. We store prompts and generated content to provide the Services and for the other purposes described below.
Public posts and interactions. Generating content does not automatically publish it. If you choose Post, your video and its caption, username, profile information, posting date, and related interactions may be visible to other users and the public. We also collect your likes, comments, follows, reports, and other activity. Others may save or share public material beyond our control.
Usage and device information. We and our technology partners collect information such as IP address, device and browser type, operating system, app version, language, device or advertising identifiers, approximate location inferred from IP address, pages or screens visited, searches, features used, generation activity, referral information, logs, crashes, and diagnostic data.
Payment and subscription information. Apple, Google, and other app marketplaces process in-app purchases under their own policies. Stripe processes website payments. We receive information needed to administer purchases, such as transaction identifiers, subscription status, purchase history, payment status, and limited billing or payment-method details. We generally do not receive complete payment-card numbers.
Cookies, SDKs, and similar technologies. We and our partners use cookies, pixels, software development kits, local storage, and identifiers to keep you signed in, operate features, measure usage, prevent abuse, and support analytics and advertising. Some advertising partners may use information about your use of VideoGPT to measure or deliver ads across services, depending on their configuration and your choices.
2. How we use information
We use information to create and manage accounts; authenticate users; process AI requests; store and deliver content; operate the feed and interactions; manage subscriptions; provide support; personalize the Services; analyze usage and performance; develop, test, and improve features and AI systems; train, fine-tune, or evaluate AI systems; moderate content; detect security incidents, fraud, and abuse; enforce our Terms; communicate about the Services; comply with law; and protect legal rights.
We may use prompts, uploads, outputs, feedback, and related information to improve and train our AI systems. We may also send this information to AI providers to process requests. Do not submit confidential or sensitive information, or another person's material, unless you have the necessary rights and are comfortable with this processing. Deleting material from your account does not necessarily undo processing or model improvements already completed.
3. AI and other service providers
Depending on the feature you use, we may send prompts, uploads, reference files, outputs, and related information to AI providers including FAL.ai, OpenAI, Google (including Gemini), Anthropic, and BytePlus. We also use providers for hosting, storage, content delivery, authentication, payments, analytics, advertising, communications, support, moderation, and security. Providers process information as needed to deliver their services to us and under applicable agreements and policies. A particular request may be routed to different providers depending on the feature and model.
4. When information is disclosed
We disclose information to the service providers described above; to other users and the public when you choose to post; to a successor in a merger, financing, acquisition, or sale of assets; and when reasonably necessary to comply with law, respond to rights complaints, investigate abuse, protect safety, or establish or defend legal claims.
Advertising and analytics partners may collect or receive device and activity information through cookies, pixels, SDKs, and similar tools. Under some privacy laws, certain advertising disclosures may count as a “sale,” “sharing,” or targeted advertising even when we receive no money for the data.
5. Your choices and privacy rights
You can choose whether to post generated material publicly and may be able to edit or delete content and profile details using the Services. You can adjust certain cookies through your browser, device advertising settings through your device, and app permissions through your operating system. Disabling these technologies may affect features. Platform controls may also apply to some in-app tracking.
Depending on where you live and which laws apply to us, you may have rights to access, correct, delete, or obtain a copy of personal information; learn about categories of information we collect and disclose; opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive information; withdraw consent; or appeal a privacy decision. To make a request, including a request to opt out of sale or sharing, email [email protected] with “Privacy Request” in the subject line. We may verify your identity and will respond as required by applicable law. We will not discriminate against you for exercising a legal privacy right.
If your browser or device sends a legally recognized opt-out preference signal, we will process it as required by applicable law. Where consent is required for particular technologies or uses, we will seek it as required by law.
6. Retention and deletion
We retain information for as long as reasonably necessary to operate the Services, maintain accounts and subscriptions, improve products, prevent abuse, meet legal obligations, resolve disputes, and enforce agreements. The period depends on the data and its purpose. If you want to delete your account or content and cannot do so in the Services, contact [email protected]. Some information may remain in backups or records where retention is necessary or permitted by law. Content others copied or shared after you posted it publicly may remain outside VideoGPT.
7. Children and teens
VideoGPT is for people 13 and older. It is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child under 13 has used the Services, email [email protected] so we can investigate and take appropriate action. Users under 18 should avoid posting personal details about themselves or others. Additional restrictions or consent requirements may apply by location or feature.
8. Security and international processing
We use administrative, technical, and organizational measures designed to protect information, but no electronic system is perfectly secure. We and our providers may process and store information in the United States and other countries, which may have different privacy laws. Where required, we use legally appropriate safeguards for international transfers.
9. Third-party services, changes, and contact
Links and integrations with third-party products are subject to their independent privacy practices. We may update this Policy and will change the effective date above. If a material change requires additional notice or consent, we will provide it as required by law.
For privacy questions or requests, contact ElevenThirteen LLC at [email protected].
VideoGPT Terms of Service
Effective date: September 23, 2026
These Terms of Service (“Terms”) govern the VideoGPT websites, apps, AI generation tools, public feed, and related services (the “Services”) provided by ElevenThirteen LLC (“VideoGPT,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 13 years old. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms with you. Additional age and consent rules may apply in your location. You must provide accurate account information and keep your account secure. You are responsible for activity through your account to the extent permitted by law. Contact [email protected] promptly if you suspect unauthorized access.
2. AI generation and your decision to post
You may submit prompts, images, videos, audio, and other reference materials (“Inputs”) to create generated material (“Outputs”). You may also provide captions, comments, profile information, and other content. Together, these are “User Content.” A generation remains private unless you affirmatively choose to Post it. If you post, other people may see, copy, and share your content. Deleting a post from our Services cannot remove copies made elsewhere.
Outputs may be inaccurate, unexpected, similar to someone else's work, or affected by the rights of others. Review them before use or publication. VideoGPT does not promise that an Output is original, copyrightable, free of third-party rights, or suitable for a particular purpose. Generation of a recognizable character, brand, song, person, face, or voice does not grant permission from the relevant rightsholder or person.
3. Rights and responsibilities
As between you and VideoGPT, you retain whatever rights you have in your Inputs and other User Content. Subject to applicable law and third-party rights, you may use Outputs generated for you. These Terms cannot give you rights owned by others or guarantee that an AI-generated work has copyright protection.
You are responsible for your Inputs and your decision to use or post Outputs. You represent that you have the rights, permissions, and lawful basis needed to submit your Inputs and to use and publish your User Content, and that doing so will not violate copyright, trademark, privacy, publicity, or other rights or applicable law. You must consider the facts of a particular use before relying on an exception such as fair use; calling a work “parody” or “AI-generated” does not by itself make it lawful.
You grant ElevenThirteen LLC a worldwide, nonexclusive, royalty-free license to host, copy, process, adapt as technically needed, transmit, display, and distribute User Content to operate, secure, moderate, and improve the Services. For content you choose to post, this includes showing it in the feed and through our discovery, recommendation, preview, and sharing features. Other users may access and interact with public posts through the features we offer. We may use eligible Inputs, Outputs, and feedback to develop, evaluate, train, and improve our AI systems as explained in the Privacy Policy. The license continues while content is on the Services and, after deletion, to the extent reasonably necessary for backups, previously shared copies, safety, compliance, disputes, and completed improvements, subject to applicable law and the Privacy Policy.
4. Rules and moderation
Do not use the Services to infringe rights, impersonate someone deceptively, harass others, submit unlawful material, evade account restrictions, or interfere with the Services. Do not post content unless you have a lawful basis to make it public. We may investigate reports and remove or restrict content, limit features, suspend or terminate accounts, and cooperate with lawful processes. We may act before or after a report and do not promise to review every post before publication.
5. Copyright complaints and repeat infringement
Rights holders or their authorized representatives may report claimed copyright infringement by emailing [email protected] with the subject “Copyright Complaint.” Include your signature, identification of the copyrighted work, the exact VideoGPT post URL or other information sufficient to locate the material, your contact information, a statement that you have a good-faith belief the challenged use is not authorized by the owner, its agent, or the law, and a statement that your information is accurate and that you are authorized to act for the owner under penalty of perjury.
We will review reports and promptly remove or disable material when warranted. We may seek missing details and notify the affected user. A user who believes a copyright removal resulted from a mistake or misidentification may email the same address with the subject “Copyright Counter-Notice” and include a signature; identification and former location of the material; a statement under penalty of perjury of a good-faith belief that removal was due to mistake or misidentification; name, address, and telephone number; consent to the jurisdiction of the relevant U.S. federal district court (or, if outside the United States, any district where ElevenThirteen LLC may be found); and agreement to accept service of process from the original complainant or its agent. We may share a counter-notice with that complainant. We will handle restoration in accordance with applicable law and consider any separate lawful reason to keep material offline.
We maintain a policy of terminating accounts of repeat copyright infringers in appropriate circumstances. We record qualifying incidents and consider valid complaints, other documented infringement, successful disputes, withdrawals, seriousness, and evasion. We may warn, restrict, suspend, or terminate an account, including sooner for serious or deliberate conduct. We accommodate qualifying standard technical measures as required by law. To report trademark, impersonation, privacy, or likeness concerns, email [email protected] with relevant URLs and an explanation; a copyright notice is not necessarily the procedure for these other rights.
[email protected] is currently a general reporting contact and is not identified here as a registered DMCA agent. We may update this section if we designate and register an agent with the U.S. Copyright Office.
6. Purchases and subscriptions
Paid features, prices, billing periods, trial terms, credits, and renewal terms are disclosed at purchase and may differ by platform or plan. Subscriptions generally renew unless canceled before the next renewal under the terms shown at purchase. Manage an Apple or Google subscription in the relevant store account. For a website purchase processed by Stripe, follow the cancellation instructions in your account or purchase confirmation; if you cannot locate them, email [email protected] with “Billing” in the subject line. Canceling future renewal does not itself refund an existing charge. Store purchases are subject to the store's refund process. Contact us for a website billing or refund question. Your mandatory consumer rights still apply.
7. Changes, termination, and deletion
Features and providers may change or become unavailable. We may update these Terms and will revise the effective date. We will provide additional notice where law requires it. You may stop using the Services and request deletion at [email protected]. We may suspend or terminate access for violations, repeat infringement, legal requirements, or threats to users or the Services. Provisions that by their nature should continue, including accrued payment duties, authorized retention of content, limitations, and dispute-related provisions, survive as permitted by law.
8. Disclaimers and liability
To the extent permitted by law, the Services and Outputs are provided “as is” and “as available” without warranties of continuous availability, accuracy, fitness for a particular purpose, noninfringement, or exclusive ownership of Outputs. We do not exclude warranties or consumer rights that cannot legally be excluded.
To the extent permitted by law, ElevenThirteen LLC and its affiliates, personnel, and providers are not liable for indirect, incidental, special, consequential, or punitive damages or loss of profits, data, or goodwill arising from the Services. To the extent permitted by law, their total liability for a claim relating to the Services will not exceed the greater of $100 or the amount you paid ElevenThirteen LLC for the Services in the twelve months before the event giving rise to the claim. These limits do not apply to liability that cannot legally be limited.
9. Indemnification
To the extent permitted by law, you agree to defend and indemnify ElevenThirteen LLC and its affiliates, personnel, and providers against third-party claims and reasonable expenses arising from your User Content, your use or posting of Outputs, or your material violation of these Terms or another person's rights, except to the extent resulting from our own unlawful conduct. We will give reasonable notice and permit you to participate in the defense as appropriate.
10. Contact and general terms
Contact ElevenThirteen LLC at [email protected] for questions about these Terms. If any provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision immediately is not a waiver.
